These terms apply to the Pink Elephant Academy at pinkelephantmedia.com/academy, and to the courses, downloads, workshops and 1:1 sessions we provide. Our privacy policy is further down this page.
1. About us and these terms
1.1 The Pink Elephant Academy (“the Academy”) is run by Pink Elephant Media Ltd, a company registered in England and Wales (company number 11974626), whose registered office is Yew Tree House, Atcombe Road, South Woodchester, Stroud, Gloucestershire, GL5 5EW (“we”, “us”, “our”).
1.2 These terms apply when you create an account, join the Academy, take a course, download a resource, or book a workshop or 1:1 session with us. By doing any of these you agree to them.
1.3 The Academy teaches you marketing, and shows you how to set up and use AI tools for your own business, including building what we call your AI Marketing Brain. We provide training. We do not run your marketing for you, and we do not provide or manage AI software on your behalf.
1.4 If you are buying for a business, you confirm you are allowed to accept these terms for that business.
2. Membership, payment and cancelling
2.1 Free account. You can create a free account and take our free course, How Marketing Really Works, without paying. We may change what is free at any time.
2.2 Paid membership. Membership gives you access to the Academy courses, tools and downloads for as long as your membership is active. The current plans are:
| Plan |
Price |
Commitment |
| 12 month plan |
£45 a month |
12 month minimum, then cancel any time |
| Month by month |
£75 a month |
Cancel any time |
2.3 Prices are shown on the website at the time you join and include VAT. Payments are taken monthly in advance by the payment method you give us. If a payment fails, we may pause your access until it is paid.
2.4 The 12 month plan runs for 12 months from the day you join. You agree to pay all 12 monthly payments, even if you stop using the Academy. After 12 months it continues month to month at the same price until you cancel.
2.5 Cancelling. You can cancel from your account or by emailing us at support@pinkelephantmedia.com. Month by month plans end at the end of the month you have paid for. Your access stops when your membership ends.
2.6 What you keep. When your membership ends you lose access to the courses and downloads, but you keep everything you have built for your own business, including your AI Marketing Brain and the work you created with it (see section 7).
2.7 Price changes. We may change our prices. We will give you at least 30 days’ notice before a new price applies to you, and it will not apply during your first 12 months on the 12 month plan.
2.8 Pink Elephant website clients. Clients with an active Pink Elephant Media website may be given free access to the AI training. That access lasts for the period we tell you when we give it, and we may end it if the website arrangement ends.
3. Your account
3.1 Your membership is for one named person. You must not share your login, or let anyone else use your account.
3.2 Course videos, booklets, workbooks, templates, prompts and tools are for your own use in your own business. You must not share, copy, resell, publish or pass them on to anyone else, including colleagues, clients or other businesses. If you want access for a team, ask us about a team licence.
3.3 You are responsible for keeping your login details safe and for the accuracy of the details you give us, including a working mobile number and email address.
3.4 We may suspend or close an account without a refund if it is shared, if content is passed on, or if it is used in a way that breaks these terms or the law. Where it is fair to do so, we will contact you first.
4. What the training is, and what it isn’t
4.1 Our courses, workshops and sessions are education and general guidance. They are not legal, financial, tax or data protection advice, and they are not tailored to your business unless we agree that in writing (for example, in a 1:1 session).
4.2 No guaranteed results. We share methods that have worked for us and our clients, but results depend on your business, your market, your offer and what you put in. We do not promise any level of enquiries, sales, rankings, followers or income.
4.3 Example figures. Figures used in our courses, adverts, calculators and examples (including example businesses such as “Jo the kitchen fitter”) are illustrations. They are not predictions of what you will achieve. Prices quoted for agencies and other services are typical market figures, shown for comparison.
4.4 Your decisions. You decide what to do in your business, and you are responsible for those decisions and their results, including what you spend on tools, advertising and staff.
4.5 Keeping things current. Marketing platforms and AI tools change often. We work to keep courses up to date, but screens, features, prices and rules may change after a course is recorded. Always check the current version of any tool you use.
4.6 Links to other courses. Courses refer to each other. Some may be marked “coming soon” and released over time. We don’t guarantee a release date, and the content of a future course may change.
5. AI tools and your AI Marketing Brain
5.1 Your tools, your accounts. Our courses show you how to set up AI tools (such as Claude) and other software (such as a CRM, email platform, prospecting or scheduling tools) for your business. You choose which tools to use, open the accounts in your own name, and pay the providers directly. Your Academy membership does not include any third party subscriptions.
5.2 Their terms apply. Every tool has its own terms, privacy policy, pricing and usage limits. You are responsible for reading and following them. We are not responsible for a third party tool’s availability, changes, pricing, errors or how it handles your data.
5.3 Check before you use it. AI can produce wrong, out of date or unsuitable content. You must read and check anything an AI tool produces (posts, emails, website copy, prospect lists, scores, advice) before you rely on it, publish it or send it. Our method is built around you approving every message before it goes out. You are responsible for what you publish and send.
5.4 Connecting your accounts. Some courses show you how to connect AI to your email, CRM, accounts or other data. Only connect what you are comfortable with, use the permissions the course recommends (starting read only where possible), and never share passwords, card details or bank details with an AI tool. If you would rather not connect, each course shows another way to do the same step.
5.5 Automation. Where you set up a tool to act automatically (for example, scheduling posts or sending follow ups), you remain responsible for what it does. Test it, check it regularly and switch it off if something goes wrong.
5.6 What we can see. We cannot see your AI tools, connected accounts or the data in them, unless you choose to show us in a 1:1 session.
6. Your customers’ data and marketing law
6.1 You are in charge of your data. When you use AI or other tools with information about your customers, enquiries or prospects, you are the controller of that personal data under UK data protection law (UK GDPR and the Data Protection Act 2018). You are responsible for having a lawful reason to use it, keeping it secure, telling people how you use it (for example, in your privacy notice), and not putting more into AI tools than you need.
6.2 Marketing emails, texts and calls. The rules on electronic marketing (the Privacy and Electronic Communications Regulations, PECR) apply to what you send. In general you need permission to send marketing emails or texts to individuals, and must always offer a way to opt out. Our courses explain the basics, but you are responsible for following the rules, including when you add people to follow up sequences.
6.3 Prospecting and contact data. If you use prospecting or data tools (for example, Apollo or Hunter), or information from Companies House or networking groups, you are responsible for using that data lawfully, checking the provider’s terms, and respecting anyone who asks you to stop contacting them.
6.4 Platform rules. LinkedIn, Facebook, Instagram, Google and other platforms have their own rules on automation, data collection and messaging. You are responsible for following them. We do not teach you to break any platform’s terms, and you use automation tools at your own risk.
6.5 Reviews and testimonials. If you ask customers for reviews, they must be genuine. Don’t write, buy or reward reviews in a way that breaks the law or the platform’s rules.
6.6 Our use of your data. How we use your own personal data as an Academy member is explained in our privacy policy. This includes sign up details passed to our CRM so we can manage your membership and, where you have agreed, send you marketing.
7. Who owns what
7.1 Our content. All Academy content belongs to us or the people we license it from. That includes videos, scripts, slides, booklets, workbooks, calculators, tools, templates, prompts, instructions, GIFs, our method and our brand names (including “AI Marketing Brain”).
7.2 Your licence. While your membership is active, we give you a personal, non transferable licence to use our content to learn and to build marketing for your own business. You must not copy it into training, products or services you sell or give to others.
7.3 What you build is yours. The AI Marketing Brain you set up, the instructions you adapt for your own business, and the content you create with it (posts, emails, web pages, plans) belong to you, and you can keep using them after your membership ends. This doesn’t give you the right to republish our course materials themselves.
7.4 Your feedback and results. If you send us feedback, ideas or results, we may use them to improve the Academy. We will only use your name, business name, quote, photo or video in our marketing with your permission.
8. Workshops and 1:1 sessions
8.1 Live workshops, the AI Accelerator Programme and 1:1 sessions are booked separately unless we say they are included in your membership. The price, length and what is included will be set out when you book.
8.2 Rescheduling. If you need to move a session, please give us at least 48 hours’ notice and we will find another time. Sessions missed without notice may be lost. If we have to cancel, we will offer a new date or a refund for that session.
8.3 Free first session. Where we offer a free first hour, it is to see whether we can help. There is no obligation to buy anything afterwards.
8.4 Recordings. We may record live workshops for members to watch later. We will tell you before recording. Please don’t record sessions yourself without asking.
8.5 Your information in sessions. Anything you share about your business in a 1:1 session is treated as confidential and only used to help you.
9. Liability, your rights and the rest
9.1 If you are a consumer. If you join as an individual rather than a business, you normally have 14 days to cancel. Because the Academy is digital content, when you join you will be asked to agree that access starts straight away and that you lose the right to cancel once you start using it. Nothing in these terms affects your other legal rights as a consumer.
9.2 Our responsibility. We will provide the Academy with reasonable care and skill. We are not responsible for losses we could not reasonably foresee, for business losses (such as lost profit, sales, data or opportunity) where you use the Academy for business, or for anything caused by third party tools, platforms or AI output (see section 5).
9.3 Limit. Where the law allows, our total liability to you is limited to the amount you have paid us in the 12 months before the claim. Nothing limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit.
9.4 Changes to the Academy. We may add, update, rename, combine or retire courses and tools to keep them useful. If we remove something that was a main reason you joined, tell us and we will try to put it right.
9.5 Changes to these terms. We may update these terms. We will post the new version on this page and tell members by email about any important change.
9.6 Things outside our control. We are not responsible for delays or problems caused by events outside our reasonable control, including outages of the website, hosting, payment or third party tools.
9.7 Questions and complaints. Please contact us at support@pinkelephantmedia.com. We aim to reply within 5 working days.
9.8 Law. These terms are governed by the law of England and Wales, and the courts of England and Wales can deal with any dispute.
